1. Acceptance of Terms
By accessing and using the Ket-Pass software, website, and associated services provided by Gepton.com (managed by Ketpy), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services. These terms apply to all visitors, users, clients, and licensees of Ket-Pass.
2. Description of Service
Ket-Pass is an event entry management software system that provides QR code generation, ticket verification, attendee management, and related event administration tools. The software is provided as a licensable product that users can host on their own servers, as well as potentially through hosted service arrangements.
3. License Grant
Upon purchase and payment confirmation, Gepton.com grants you a non-exclusive, non-transferable license to install and use Ket-Pass in accordance with the purchased license tier. The license is valid for the duration specified in your purchase agreement. You may not:
- Redistribute, resell, or sublicense the software without written permission
- Reverse engineer, decompile, or disassemble the software
- Remove or alter any copyright notices or proprietary markings
- Use the software for unlawful purposes or to facilitate illegal activities
- Share your license with third parties without a white-label agreement
4. User Responsibilities
You are responsible for: maintaining the security of your admin credentials; ensuring accurate attendee data is entered into the system; compliance with applicable privacy and data protection laws in your jurisdiction; ensuring you have proper server infrastructure to run the software; and obtaining any necessary consent from attendees whose data you collect and store.
5. Intellectual Property
Ket-Pass, its design, code, branding, and all associated materials are the intellectual property of Gepton.com. You may not claim ownership, rebrand without authorization, or use our trademarks without permission. White-label clients receive specific rights defined in their white-label agreement.
6. Data and Privacy
You, as the operator of the Ket-Pass installation, are the data controller for all attendee data you collect. Gepton.com is not responsible for how you collect, use, store, or share attendee data. You must have a lawful basis for processing personal data and must comply with applicable privacy laws including, but not limited to, India's Digital Personal Data Protection Act 2023.
7. Limitation of Liability
Gepton.com and Ketpy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from your use or inability to use the software, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the license in the 12 months preceding the claim.
8. Modifications to Terms
Gepton.com reserves the right to modify these terms at any time. Changes will be posted on our website and, where material, we will notify active clients via email. Continued use of the software after changes constitutes acceptance of the modified terms.
9. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana, India.
